In some situations, an employer may be exempt from holding a workers compensation insurance policy.

Exemptions from holding a workers compensation policy

As an employer in NSW, you do not need to have a workers compensation insurance policy if you meet the following requirements:

  • Your business pays $7,500 or less in wages during a financial year
  • You do not employ an apprentice or trainee
  • You are not a member of a group of related businesses for premium purposes.
  • You are not involved in certain industries such as taxi driving, hire car driving, horse racing, professional boxing, wrestling or combat sports as these industries are subject to the $0 exemption limit outlined in the Workers compensation market practice and premium guidelines.

Responsibilities of exempt employers

Even if you are exempt from holding an insurance policy, you must still provide assistance with injury management and return to work.
Additionally, if a worker with an injury makes a claim, you need to:

  • call us on 13 74 72 so we can arrange for icare to manage the claim, and
  • pay a $175 administration fee.

Changes in your situation

If your circumstances change and you no longer meet the exemption criteria (for example, you pay more than $7,500 a year in wages), you must contact an insurer immediately to take out a workers compensation insurance policy.
