SIRA has issued a Letter of Censure to Bluescope Steel Limited (Bluescope) for failing to correctly apply indexation to a workers' compensation claim

SIRA has issued a Letter of Censure to Bluescope Steel Limited (Bluescope) for failing to correctly apply indexation to a workers' compensation claim, in violation of the Workers Compensation Act 1987.

SIRA’s review found that Bluescope did not comply with sections 82A and 82D of the Act, which requires insurers to apply indexation and rounding to a worker’s pre-injury average weekly earnings for the purposes of the calculation of weekly payments on 2 review dates annually.

Due to the importance of accurate workers compensation payments and delays in assessing potentially impacted workers, SIRA decided the appropriate enforcement action in this instance was to issue a Letter of Censure.

Bluescope has acknowledged this indexation breach and implemented a remediation plan to review other potentially impacted workers. SIRA is supervising Bluescope’s review and remediation actions through to completion.
