SIRA imposes special conditions on Liberty Holdings Australia Limited’s workers compensation licence

On 28 February 2024, SIRA imposed special licence conditions on Liberty Holdings Australia Limited’s (Liberty) workers compensation self-insurer licence.

The conditions were imposed due to SIRA’s concerns about the performance of Liberty’s self-insured workers compensation claims management practices.

SIRA compared the results of self-audits submitted by Liberty over the past two years and identified significant issues and underperformance with compliance and case management practices.

In response, SIRA imposed the following special licence conditions on Liberty:

  • It must adhere to all actions and areas of improvement identified in the Remediation Plan submitted to SIRA in November 2023 and within the timescales specified.
  • It must provide SIRA with a monthly update on the progress and implementation of the Remediation Plan, within 10 business days of the end of each month. This continues until SIRA confirms that the Remediation Plan has been completed to a satisfactory standard.
  • It must continue to implement its quality assurance program in order to monitor the effectiveness of its Remediation Plan and claims management compliance and performance.
  • It must provide SIRA with a monthly quality assurance report to demonstrate the effectiveness of claims performance improvements, within 10 business days from the end of each month, until otherwise advised.

These special licence conditions apply to any variation or extension of Liberty’s Remediation Program, approved by SIRA in writing from time to time.

SIRA may take further regulatory action if Liberty do not demonstrate performance improvement and implementation of the Remediation Plan.
