Personal Injury Commission Statutory Review

SIRA is seeking feedback on the objectives of the Personal Injury Commission Act 2020.

  • The Issue

    What is it about?

    Section 68 of the Personal Injury Commission Act 2020 (the Act) requires the Minister to commence a review as soon as possible after a period of two years from the establishment of the Act.

    The State Insurance Regulatory Authority is leading the Statutory Review of the Act on behalf of the Minister, and this will commence from 12 August 2022.

    The purpose of the Statutory Review is to determine whether the policy objectives of the Act remain valid, and whether the terms of the Act remain appropriate for securing those objectives.

    Feedback and submissions should be submitted online or via email to [email protected]. Submissions should consider the Terms of Reference and purpose of the statutory review in their response.

    The close date for submissions is 5pm, Friday 23 September 2022, 7 October 2022.

    Next steps

    As per the Terms of Reference for the Review (below), the purpose of the Statutory Review is to determine whether the policy objectives of the Act remain valid, and whether the terms of the Act remain appropriate for securing those objectives.

    The review will not consider matters relating to:

    • the design and operation of the Compulsory Third-Party (CTP) and Workers Compensation legislation, or
    • operational or performance matters relating to the Personal Injury Commission.

    SIRA has established an Advisory Committee to provide advice and guidance to the Statutory Review recommendations and final report. This Advisory Committee will consist of The Hon. Greg Keating, Nancy Milne OAM, Professor Tania Sourdin and Elizabeth Welsh.

    Report on the outcome of the Statutory Review

    The Report on the outcome of the two-year Statutory Review of the Personal Injury Commission Act 2020 was tabled in Parliament on 14 August 2023.
