Home building compensation disputes

If you’re a builder not satisfied with the decision regarding your eligibility outcome, or a homeowner not satisfied with the decision regarding your claim outcome, you can request a review.

For builders

If you are not satisfied with a decision about your eligibility for home building compensation (HBC) cover, you can ask your broker to arrange a review or ask us (the State Insurance Regulatory Authority) to conduct a regulator compliance review about the way your application was handled.

If you think your matter was not handled in accordance with the HBC insurance guidelines, you can complain to us at the State Insurance Regulatory Authority.

For home owners

If you’re not satisfied with a decision about your HBC claim, you can apply to the NSW Civil & Administrative Tribunal (NCAT), or the District Court where the amount involved exceeds the NCAT’s $500,000 jurisdictional limit to review your application and to make a determination.

You can also ask us to conduct a regulator compliance review about the way your claim was handled.

The regulator compliance review will determine if a licensed HBC provider has not followed:
