Workers Compensation Regulation 2010 remade
The Workers Compensation Regulation 2010 (2010 Regulation) has now been remade, with minor amendments, as the Workers Compensation Regulation 2016 (2016 Regulation).
The 2016 Regulation commences on 1 September 2016 and replaces the 2010 Regulation which is scheduled for automatic repeal on the same day (under section 10 of the Subordinate Legislation Act 1989).
To support transition to the new regulation, SIRA has published a fact sheet which provides an overview of the changes, as well as a detailed table of amendments which lists all changes and includes cross references for clause numbers and specific provisions between the 2010 and 2016 Regulations. These are available on SIRA’s website, along with the Regulatory Impact Statements and public consultation documents.
This remake focused on minor and machinery amendments to update and improve the existing regulation ahead of its automatic repeal on 1 September 2016. The 2016 Regulation also incorporates amendments made to the 2010 Regulation during 2016 to implement the Market Practice and Premiums Guidelines and Return to Work Assistance benefits. Due to their substantive and specialised nature, these amendments were progressed concurrently with, but separately to, the remake of the 2010 Regulation.
During the public consultation period SIRA received feedback on some broader policy and stakeholder issues. While these suggestions were outside the scope of the current remake, the feedback identified opportunities for better regulation and SIRA will use the feedback to guide future better regulation projects. We will keep you informed and invite your participation in the projects as they develop.
Work continues on issues related to pre-injury average weekly earnings and, legal costs for work capacity decisions and any further enhancements to the 2016 Regulation relating to these issues will be announced in the future.

Workplace rehabilitation providers evaluation manual amended
Workplace rehabilitation providers are advised that the evaluation manual for approved workplace rehabilitation providers has been amended.
The changes have been made to simplify the manual, remove duplication and align with the updated Guide: Nationally Consistent Approval Framework for Workplace Rehabilitation Providers.
A standalone tool has also been developed to assist the evaluation process and is also available on the website.
The manual and tool are available from the Heads of Workers Compensation Authorities (HWCA) website.
